What this site collects, why, and what you can ask for. This is my notice under Türkiye's Law No. 6698 on the Protection of Personal Data (KVKK). Türkçe metin aşağıda.

Who is responsible

This site is run by Mert Uzunoğlu, a freelance motion designer in Istanbul, Türkiye. I am the data controller for the personal data collected through it. For anything about your data, write to hello@mertuzunoglu.com.

What I collect, and how

Only what you send me, electronically: through the contact form on this site, or by email. The form asks for your name, email address, company (if you give one) and message. Like every website, the site's host also sees your IP address and browser details when you visit, to deliver the pages and keep them secure.

Why, and on what legal grounds

I use what you send to reply to you and, if we work together, to plan and carry out the project. The legal grounds are that the processing is needed to set up or perform a contract with you (KVKK Article 5/2-c) and my legitimate interest in answering enquiries and keeping the site safe from spam and abuse (Article 5/2-f). If we work together, I keep the records the law requires, such as invoices (Article 5/2-ç).

The contact form

Your message is emailed to my own mailbox and kept by Cloudflare, which hosts the site, for 30 days at most; after that it is deleted automatically. To stop spam the form counts messages per sender for one hour, using a scrambled form of your IP address, never the address itself. The form page also uses Cloudflare Turnstile, which looks at your browser to tell a person from a bot (usually without asking you anything) and is not used for advertising.

How long I keep it

Form messages stay on Cloudflare for 30 days at most. Emails stay in my mailbox as long as we are talking or working together, and then for as long as I may need them for the work or a legal claim. If we work together, invoices and other accounting records are kept for the periods Turkish law sets (10 years under the Tax Procedure Law and the Commercial Code). After that I delete them.

Who receives it, in Türkiye and abroad

I don't sell your data or share it for marketing, and I don't add you to mailing lists. Two service providers handle it for me: Cloudflare, Inc. (hosting, the contact form, spam protection) and Google (email). Both keep data on servers outside Türkiye, including the United States, so the data described here is transferred abroad. Both providers commit, in their own data processing terms, to protect the data they handle for me. If we work together, I may also have to share records with public authorities, my accountant or a court when the law requires it.

Analytics and cookies

This site uses no analytics and sets no cookies.

Your browser notes which pages you have already opened during this visit, so the work doesn't animate in twice. This stays in your browser, is not a cookie and is never sent to me.

Your rights

Under KVKK Article 11 you can ask me:

Write to hello@mertuzunoglu.com, preferably from the address you used with me, so I can tell it is you. I will answer within 30 days, free of charge. You can also complain to the Personal Data Protection Authority at kvkk.gov.tr.

Hangi veriler, nasıl toplanır

Yalnızca bana elektronik ortamda gönderdikleriniz: sitedeki iletişim formu ya da e-posta yoluyla. Form adınızı, e-posta adresinizi, varsa şirketinizi ve mesajınızı ister. Her web sitesinde olduğu gibi, siteyi barındıran hizmet de sayfaları sunmak ve güvenliği sağlamak için IP adresinizi ve tarayıcı bilgilerinizi görür.

İşleme amaçları ve hukuki sebepler

Gönderdiklerinizi size cevap vermek ve birlikte çalışırsak projeyi planlayıp yürütmek için kullanırım. Hukuki sebepler: bir sözleşmenin kurulması veya ifası için gerekli olması (KVKK m. 5/2-c), sorulara cevap verme ve siteyi spam ile kötüye kullanımdan koruma konusundaki meşru menfaatim (m. 5/2-f) ve birlikte çalışırsak fatura gibi kanunen tutmam gereken kayıtlar için hukuki yükümlülüğüm (m. 5/2-ç).

İletişim formu

Mesajınız e-posta kutuma iletilir ve siteyi barındıran Cloudflare'da en fazla 30 gün tutulur, sonra kendiliğinden silinir. Spam'i önlemek için form, gönderen başına mesajları bir saat boyunca sayar; bunun için IP adresinizin kendisi değil, karıştırılmış (hash) bir biçimi kullanılır. Form sayfasında ayrıca, insanı bottan ayırmak için tarayıcınıza bakan ve reklam için kullanılmayan Cloudflare Turnstile çalışır.

Saklama süreleri

Form mesajları Cloudflare'da en fazla 30 gün kalır. E-postalar, yazıştığımız ve birlikte çalıştığımız sürece, sonrasında da iş veya olası bir hukuki talep için gerekebileceği kadar e-posta kutumda kalır. Birlikte çalışırsak fatura ve diğer muhasebe kayıtları Türk hukukunun öngördüğü süre boyunca (Vergi Usul Kanunu ve Türk Ticaret Kanunu'na göre 10 yıl) saklanır. Bu sürelerin sonunda silinir.

Aktarım: kimlere, hangi amaçla

Verilerinizi satmam, pazarlama için paylaşmam, sizi bir e-posta listesine eklemem. Verileri benim adıma iki hizmet sağlayıcı işler: Cloudflare, Inc. (barındırma, iletişim formu, spam koruması) ve Google (e-posta). İki şirket de verileri Amerika Birleşik Devletleri dahil Türkiye dışındaki sunucularda tutar; bu nedenle burada anlatılan veriler yurt dışına aktarılır. Bu iki sağlayıcı, kendi veri işleme koşullarında benim için işledikleri verileri korumayı taahhüt eder. Birlikte çalışırsak, kanunun gerektirdiği durumlarda kayıtları yetkili kamu kurumlarıyla, mali müşavirimle veya mahkemeyle paylaşmam gerekebilir.

Haklarınız

KVKK'nın 11. maddesi uyarınca benden şunları isteyebilirsiniz:

  • kişisel verilerinizin işlenip işlenmediğini öğrenmek, işlenmişse buna ilişkin bilgi talep etmek;
  • işlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenmek;
  • yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilmek;
  • eksik veya yanlış işlenmişse düzeltilmesini istemek;
  • 7. maddedeki şartlar çerçevesinde silinmesini veya yok edilmesini istemek;
  • düzeltme, silme veya yok etme işlemlerinin, verilerin aktarıldığı üçüncü kişilere bildirilmesini istemek;
  • münhasıran otomatik sistemlerle analiz edilmesi sonucu aleyhinize bir sonucun ortaya çıkmasına itiraz etmek;
  • kanuna aykırı işleme nedeniyle zarara uğrarsanız zararın giderilmesini talep etmek.
